You can browse and order from the Site without an account — creating one is optional. If you do register, you agree to provide accurate information and keep it current. You are responsible for keeping your sign-in credentials confidential and for all activity under your account. If you believe your account has been accessed without your authorisation, contact us immediately. We may suspend or close an account as described in the Termination section below.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for your own personal, non-commercial purposes. You may not:

• copy, reproduce, republish, sell, or commercially exploit the Site or its content;
• modify, create derivative works from, or reverse-engineer any part of the Site;
• use automated tools to scrape or extract data from the Site; or
• use the Site to build a similar or competing product or service.

All intellectual property rights in the Site and its content — including the Spicey-O name, logo, product names, images, and text — belong to Spicey-O or our licensors. We may modify, suspend, or discontinue the Site (or any part of it) at any time. If you share feedback or suggestions with us, you grant us a perpetual, royalty-free licence to use that feedback for any purpose, without attribution.

Placing an order is an offer to buy. An order is confirmed only once your payment completes successfully. We may refuse or cancel an order — for example where a product is unavailable, a price was displayed in error, or we suspect fraud — and if payment was already collected for a cancelled order, we will refund you.

Product images are illustrative. Our products are food items — always check the product label for ingredients and allergen information before consuming.

Prices are shown in Kenyan Shillings (KES). The total payable, including any delivery fee, is shown at checkout and is always recalculated from our current prices when you pay. Orders must total between KES 101 and KES 250,000.

Payment is by Kenyan mobile money (M-Pesa or Airtel Money) and is processed by our third-party payment provider. When you check out, a payment prompt is sent to the phone number you provide, so an accurate phone number is required to pay. You authorise the payment by entering your PIN on your own phone — we never see or store your mobile money PIN. If a payment prompt fails or expires, you can retry the payment from the order confirmation page; a new prompt is sent for each retry.

We deliver within the zones shown at checkout, and also offer collection through pickup points such as Pickup Mtaani. Delivery fees and options are displayed before you pay. Delivery and pickup timelines are estimates, not guarantees. Please provide an accurate delivery address and a reachable phone number — we are not responsible for delays or failed deliveries caused by incorrect details. Responsibility for the products passes to you on delivery or collection.

Our products are perishable food items, so we cannot accept change-of-mind returns once an order has been dispatched. If your order arrives damaged, spoiled, or incorrect, contact us on WhatsApp within 48 hours of delivery, with photos of the affected items, and we will replace them or refund you. Nothing in this section limits your rights under the Consumer Protection Act, 2012 or other applicable Kenyan law.

Your use of the Site is also governed by our Privacy Policy, which describes the personal data we collect, how we use it, and the choices you have. It forms part of these Terms.

The Site relies on third-party services — including our payment provider, address autocomplete, and links to WhatsApp and social media platforms. We do not control those services, and your use of them is subject to their own terms and privacy policies.

The Site is provided "as is" and "as available". We do not warrant that the Site will be uninterrupted, error-free, or secure. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under Kenyan law.

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential losses arising from your use of the Site, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited under Kenyan law.

You agree to indemnify Spicey-O and its officers, employees, and agents against claims and reasonable costs arising out of your misuse of the Site or your violation of these Terms or applicable law.

These Terms apply while you use the Site. We may suspend or terminate your access (including any account) if we believe you have violated these Terms. Sections that by their nature should survive — including ownership, disclaimers, limitation of liability, and governing law — survive termination.

We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page and may post a prominent notice on the Site. Continuing to use the Site after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of Kenya. If you have a dispute with us, please contact us first — most issues can be resolved quickly and informally. Any dispute that cannot be resolved informally is subject to the exclusive jurisdiction of the courts of Kenya.
